These are the terms for buying a Kaima Spot. We’ve kept them short and in plain English. By ordering, you agree to them.

Who we are

Kaima Creative, a Vibethesia LLC company. When you order a Spot, your agreement is with Vibethesia LLC. Questions: [email protected].

What you get for $79

Your $79 Kaima Spot includes one custom video ad, up to 30 seconds, delivered as a watermark-free vertical (9:16) MP4. We use your brand details and add voiceover, music, and captions where they fit the idea. One round of changes is included.

You pay the $79 in full when you order.

How it works

1. After you pay, we email you a short brief to fill in.
2. We send three spot ideas within 24 hours after your brief is complete. You choose one.
3. Your first cut arrives within 24 hours after you choose an idea and we receive all requested materials. We confirm when that clock starts. Changes can add time.
4. You send your changes, we make them, and you approve the final proof before we deliver.

Your order is complete when you approve the final proof. If we don’t hear back, we’ll send you two reminders, and 30 days after our last proof we may close the order. Silence doesn’t count as approval: we deliver the clean file once you approve it in writing, even if that’s later.

Changes

One round of changes is included. A round is one set of changes to the idea you chose, sent to us together in one message.

Switching to a new idea is outside that round. So is anything after it. If you’d like more, email us and we’ll talk it through before any extra work starts.

Refunds

If none of your three spot ideas feels right, tell us before choosing one and we’ll refund your $79 in full.

Changed your mind before we send your three ideas? Tell us and we’ll refund your $79 in full.

Once you choose an idea, we start making your Spot just for you, so after that we can’t refund it, with one exception: if we miss either 24-hour deadline or a date we gave you, we’ll tell you and set a new one, and if the new date doesn’t work for you, you can ask for a full refund before we deliver. Your round of changes is there to help us get it right together.

Refunds go back through Square to the card or account you paid with.

Your claims and materials

What your ad says about your business comes from you: your website, your social pages, your brief, and what you tell us. That includes prices, offers, reviews, ratings, awards, licenses and guarantees. We don’t verify them. We don’t add claims you didn’t make. The creative side (the idea, the jokes, the characters, the style) is ours to suggest, and you approve it.

Before delivery, a person checks every Spot for pacing, readability, branding, audio, and offer clarity. That’s a check of how the ad works, not of whether its claims are true.

You approve your claims and your rights twice. When you send your brief, you confirm:

“The claims, prices, offers and materials I provide for this ad are mine and true, and I have the right to use them. Kaima Creative did not verify them.”

On the final proof, you confirm:

“The claims, prices, offers and materials in this ad are mine and true, and I have the right to use them. Kaima Creative did not verify them.”

Please send us only images, video, music, logos and likenesses you have the right to use. If your business or your offer needs fine print or a disclosure in ads, tell us what it is and we’ll put it in. Each ad platform has its own rules for paid ads, so check them before you run your Spot.

Caricatures of real people

If you want a caricature of a real person in your Spot (you, someone on your team, anyone), we need that person’s OK before we draw them and put them in your Spot. We ask for it in the brief.

What we won’t make

We can decline an order, or stop work, if something is clearly illegal. If we stop before delivery, we refund your $79.

Using your Spot

You can use the finished Spot in your business marketing.

You keep the rights you hold in the materials you provide. You let us use them to make your Spot.

Kaima keeps ownership of the mascots and characters Kaima creates: Hue, Chase, Hailey, Tiny King, and any mascot we design. You may use them only inside the Spot we deliver to you.

A caricature of a real person (you or someone on your team) is different: you can use it in your own business marketing too. We won’t use that person’s likeness anywhere else without their OK.

We won’t show your Spot publicly (on our website, our social pages or anywhere else) without your written OK.

Payment

Payments go through Square. Square handles your card details; we never see your card number.

The law

These terms are governed by the laws of the State of Colorado.

If these terms change

If we update these terms, we’ll change the date at the top. Your order is covered by the terms in place on the day you ordered.
